Product availability

All orders placed through Monica de la Rosa’s online store are subject to the availability of the product, which will be indicated in most cases on the page itself. If there is a stock shortage or any other problem related to the impossibility of supplying the order, the company undertakes to communicate within 48 hours the unavailability of the product, and reserves the right to provide information about a solution under the future availability of the product, proposing an alternative product of quality and value equal or superior to that requested or providing a promotional code for the amount of your purchase valid for 2 months.

Withdrawal of products from the online store

Monica de la Rosa reserves the right to withdraw any product from the online store at any time and/or to remove or modify any material or content of the same. We will not be liable to you or to any third party for the fact of withdrawing any product, removing or modifying any material or content of the website.

Price

The price of the products will be the price stipulated at all times in the online store of Monica de la Rosa. The prices on the website include VAT, but exclude shipping costs. Prices may change at any time, but possible changes will not affect orders for which we have already sent a Shipping Confirmation.

Inability to deliver

If for reasons attributable to the buyer (e.g. absence at the place of delivery, incorrect addresses, etc.) it is not possible to deliver the product, we will contact you in order to provide you with the appropriate information to proceed with the collection of the order.

Returns

As stipulated in article 107.1 of RDL 1/2007, Monica de la Rosa is obliged to reimburse any payment received from the consumer and user, including, where applicable, delivery costs, without undue delay and, in any case, within 14 calendar days from the date on which it has been informed of the decision to withdraw from the consumer and user contract in accordance with article 106. The entrepreneur shall make the refund referred to in the first paragraph using the same method of payment used by the consumer for the initial transaction, unless the consumer has expressly provided otherwise and provided that the consumer does not incur any costs as a result of the refund. To do so, you will only have to request such refund in the my account section of our website and you will receive the amount as soon as the administrator of the store accepts it.

What should I do if I receive a defective item?

delarosaspain.com only sells items in perfect condition, but if exceptionally you receive a garment with a defect please contact our customer service department within 24 hours of receiving the order at the email address atelier@delarosaspain.com.

Methods of payment

The payment method for purchases made on the web is through credit/debit card, Paypal and BIZUM. All transactions are carried out in compliance with all security and data protection protocols. The cardholder is responsible for the transactions on the website.

IMPORTANT: When selecting Paypal as payment method, the platform will charge you an extra 4% on the price of the order.

Value added tax

In accordance with current regulations, all purchases made through the website will be subject to Value Added Tax (VAT), except those destined for the Canary Islands, Ceuta and Melilla, in which case the taxes applicable to those territories will be applied.

Transfer of risk and ownership

The risks of the products shall be borne by the customer from the time of delivery. The customer shall acquire ownership of the products when we receive full payment of all amounts due in respect thereof, including shipping costs, or at the time of delivery, if this takes place at a later time. For the purposes of these Conditions, “delivery” shall be deemed to have occurred or the product(s) to have been “delivered” at the time of signing for receipt of the product(s) at the agreed delivery address.

Right of withdrawal

In general and in application of the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, consumers and Users have the right to withdraw from purchases made at a distance, except for those products referred to under the provisions of Article 102 of the aforementioned rule. To this effect, Mónica de la Rosa establishes a maximum period of 14 calendar days for the exercise of the aforementioned right of withdrawal. Notwithstanding the foregoing, when the customer acquires sound or video recordings, discs and computer programs, he/she may exercise his/her right of withdrawal as long as they retain their warranty seal and have not been tampered with. To exercise this right you must send us the product properly packaged together with the WITHDRAWAL DOCUMENT that is available in the online store. The costs incurred for the return of the product will be borne by the customer. The document must be sent via email to atelier@delarosaspain.com

In this way, if you are a “secured” cardholder, you will always be able to make payments with VISA or MASTERCARD in our store.

Applicable law requires that some of the information or communications we send you be in writing. By using this online store, the customer agrees that we may exchange electronic communications. Product warranty for non-conformity
